Disqualified Epic Poker League player makes his case

Wednesday night the QuadJacks.com podcast Michael Divita was able to tell his side of the story regarding his disqualification from the Epic Poker League Main Event over a 1991 conviction that landed Divita on the Sex Offender Registry.

Divita is not an Epic Poker League cardholder, and won his way into the Main Event by making the final table of the $1,500 Pro/Am tournament. However, when Divita went to register for the $20,000 Main Event he was told he was not welcome in the event and surrounded by Palms Casino security. Divita told the QuadJacks crew that he said he understood, but would like the $20,000 he fairly won in the tournament –a reasonable request.

According to Divita the Epic Poker League refused this request, instead refunding Divita’s buy-in of $1,500 from the Pro/Am. Divita then claims he was intimidated by five security guards and told by EPL Standards and Ethics Committee Chairman Stephen Martin that the EPL would make it public and he would be embarrassed.

Divita then went on to say: “As an ethical man, I will not ask for anything that I do not feel that I am due. What I was due was $20,000. What I was given was $1,500. I’d like the balance sent to me within ten days. If my money is not received by that date, I will file a lawsuit against Federated Sports & Gaming, the Epic Poker League, and all of its partners and principals, for not only my $18,500, but also additional damages for many other causes of action, including civil rights violations, against me.”

It will be very interesting to see how this case plays out considering several high-profile players who are card-carrying EPL members also have criminal records, including the highly-publicized case of Mike Matusow.
