State of Kentucky names Full Tilt Poker in lawsuit

The state of Kentucky is taking absurd and frivolous lawsuits to a whole new level. After a victory in their quest to shut down 141 online gambling domain names the state of Kentucky has upped the ante, and is now going after Full Tilt Poker; not only to shut down the online poker site, but to reclaim lost wagers on the site from Kentucky residents!

The new case against Pocket Kings, which is Full Tilt Poker’s parent company, states: “The Commonwealth is entitled to sue and recover triple the value of the money lost during the statutory period between March 25, 2005 and September 25, 2009 (the five year period preceding this Complaint but excluding the most recent six months) by persons located within the borders of Kentucky.”

Gaming law expert I. Nelson Rose was quoted in the Louisville Courier-Journal as saying the case is likely to be thrown out of court. Rose feels the application of the law to this case is “problematic”.

Kentucky’s motives for the lawsuits can be seen either as an overzealous witch hunt, or possibly as a cash grab as states, and the federal government, move towards legalizing and regulating the online gaming industry –poker included.

    Actually this is legitimate under Kentucky law. I hate it, but the statute is pretty clear. On another note, Kentucky is a commonwealth. The term “state of Kentucky” although commonly used, is technically inaccurate.
